Terms & Conditions

1. DEFINITIONS
1.1. Instructions are only accepted by Morrison Estates upon these Terms and Conditions.
1.2. “The Landlord” or “You” – The Landlord named in the instruction form or any person claiming through or under the Landlord.
1.3. “The Property” – The Property specified in thisinstruction or any part thereof including any fixturesand fittings and furniture equipment and appliancesbelonging to the Landlord but excluding any commonways or shared facilities if the Property is part only ofa building.
1.4. “The Tenant” – Any Tenant or Tenants of the Property from time to time introduced by Morrison Estates.
1.5. “Tenancy” – The entire period that the Tenant remains in occupation of the Property including the initial Letting period and any renewal period under the signed terms of the agreement.
1.6. “Initial Letting Period” – The full length of the term of any tenancy, this will not take into account any termination clause or right to terminate any tenancy, or surrender of same.
1.7. “Rent” – Shall include any sum taken as a Premium or extension or renewal of the Tenancy.
2. OWNER OBLIGATIONS
2.1. Mortgages – Where the Property is subject to a mortgage, permission is normally required by the Mortgagee to let or sub-let the Property. We will assume that you have obtained your Mortgagee’s written permission unless we are advised to the contrary in writing.
2.2. Insurances – It is your responsibility to ensure thatyou are fully insured for both building and contents and that the policy covers furnished lettings as well as Public Liability Insurance Cover. Please note that many household policies do not automatically cover such policies. Morrison Estates cannot advise on insurance matters and we recommend that you contact your insurance broker directly.
2.3. Fixtures and Fittings – You must ensure that all fixtures, fittings, gas, electrical or otherwise provided with the property are fully operational and safe, and if possible recently serviced prior to the commencement of theTenancy.
2.4. Safety Regulations – You hereby confirm that all furniture and fittings included in the letting fully comply with Fire, Gas, Electrical and general safety regulations.
2.5. From January 1st 2009, all properties offered for sale or to let must have a BER [Building Energy Rating] certificate. There are some exemptions for certain categories of buildings e.g. protected structures and certain temporary building. There are fines of up to € 5,000 for non compliance of regulations. 3. OUR SERVICES Letting Only Service
3.1. Provide advice on appropriate rental value of the Property.
3.2. Market the Property at that Price.
3.3. Take digital pictures of the Property for the purpose of marketing.
3.4. Place details of Property on our own website and daft. ie [Ireland’s largest Property Website], also property. ie and such other Property web forums as we deem appropriate from time to time including myhome2let. ie, let.ie, propertynews.com, also use of Company signboards and Newspaper Advertising as appropriate and contacting prospective tenants from the Company’s comprehensive database and also contacting our relocation service partners.
3.5. Arrange and manage accompanied viewings for your property with one of our experienced negotiators, we will also do this outside of normal working hours and weekends to accommodate the widest spectrum of clients for your property.
3.6. The Company shall obtain references in
3.7. respect of the prospective tenant, including, employment, previous landlord, bank and character references. In some circumstances Guarantors may be deemed necessary. They must be a property or business owner.
3.8. The Company shall provide a Tenancy Agreement between the Landlord and the Tenant for the period agreed [usually a 1 year fixed term].
3.9. Collect the first months rent and a security deposit equivalent to 1 months rent. The deposit is held in accordance with the lease agreement by Landlord or Agency Client Account for the term of the tenancy. Any dilapidation charges arising from a tenancy must be negotiated directly between the Landlord and the Tenant at the end of the Tenancy. Or we can provide a “Check Out” service for non managed properties at the end of tenancy for €125 plus VAT.
3.10. The Company shall arrange the set up of a standing order for monthly rental from the Tenants Account into the Landlord’s bank account.
3.11.We can provide a full Inventory of Furniture, Fixtures and Fittings at an extra cost on application. We will do this in good faith and we can be not be held responsible in any way for items of furniture or fittings misvalued or excluded from the Inventory. An overall estimated valuation can be applied to the Inventory.
3.12.Private Residential Tenancies Board Registration [PRTB] – The Company shall obtain all necessary information for completion of the PRTB registration by the landlord.
3.13.Transfer of Utilities and Meter Readings – On tenant check in, the Company shall obtain Meter Readings for Gas & ESB and arrange transfer into new tenant name/s.
3.14.Rent Collection and Repairs – The collection of rentand organisation of repairs will be the responsibility of Landlord who must communicate directly with the tenant.
3.15.Premature Termination Of Tenancy – In the event of the tenancy agreement terminating before its full term by the tenant [usually 1 year] The Company shall creditthe Landlord by way of a pro-rate proportion. This credit shall be off-set against a letting fee for a new Tenant. This credit is only available against your statement and will not be refunded in monetary terms. The said refund is not payable if the Tenancy Agreement is terminated by the owner, or if the owner has not complied with The Tenancy Agreement or Morrison Estates terms and conditions, or through any reason whereby the Tenant has lost their job or is made redundant due to economic circumstances or has not been able to enjoy peaceful occupation of the property due to neighbourly or complex management issues which effect the terms of their Tenancy Agreement.
3.16.Commission – Our Fee for the Letting Only service is 7% [Plus VAT @ 23%] of annual rent, payable at the commencement of the agreement. [Our minimum letting fee is €750 plus VAT]. At the end of the agreement term [usually 1 year] and where the tenant is continuing their tenancy we will arrange a lease renewal for €200 plus VAT or if requested we will arrange a property inspection with written report and photos, market rent review and lease renewal service for €350 plus VAT. If initially we negotiate a longer Lease Term on your behalf we would propose an additional Fee of 2% per year for each additional year negotiated.
3.17.Premium Advertising on Daft.ie – If required Morrison Estates will list your property in the premium advertising section of Daft.ie, this will guarantee your property the prime position in the listings daily and is strongly recommended. Premium advertising is an additional cost of €75 plus VAT, and the ads are valid for 1 month.
3.18.BER [Building Energy Rating] Since the 1st January 2009, homes being offered for sale or rent are now required by law to have a BER Certificate. A Building Energy Rating (BER) rates properties according to their energy efficiency within a scale from A (most energy efficient) to G (least energy efficient); similar to energy abels on household appliances. A BER lasts for a period of 10 years, and there are fines of up to €5000 for non compliance. Morrison Estates can carry out your BER, prices depending on size of property available on request.
3.19.Tax for non Resident Landlords Where the Landlord is a non-resident, the Landlord is liable to pay non resident Landlord tax of 20% of the rent and forward same to the Revenue Commissioners. If Morrison Estates are engaged to collect rent on the landlords behalf the landlord must advise if they are non resident for tax purposes. Where there is no confirmation or where the tenant understands that the landlord is non resident, the tenant is liable to deduct the tax and forward same to the Revenue Commissioners, unless otherwise confirmed that an accountant is appointed and is filing tax returns on the Landlords behalf.
COMPREHENSIVE PROPERTY MANAGEMENT SERVICE
3.20.In providing the Property Management Service, in addition to the services listed in our Letting Only Services listed, Morrison Estates will:
3.21.Act as your representative with all tenant enquiries during the term of the lease.
3.22.Where required instruct contractors to carry out repairs that may be required. Except in an emergency, estimates are obtained and submitted to you for approval in respect of works or redecoration. You have the right to waiver this restriction if so desired.
3.23.Inspect the Property - at check in, during the tenancy and at check out.
3.24.Arrange rent collection from the tenant.
3.25.Arrange to collect rent on behalf of non resident landlords and deduct tax at 20%.
3.26.Arrange end of tenancy check out and to take up utility readings for Gas & ESB.
3.27.Boiler Service – We shall arrange to have oil or gas boilers serviced by certified Engineers if so required by you.
3.28.Garden Maintenance – We shall organise routine garden maintenance such as lawncutting etc., if so requested by you.
3.29.Arrange cleaning and repairs services so that the property can be re-let quickly.
3.30.A float of €250 (or other amount to be agreed in writing) is required at the commencement and during the term of the management, to enable us to meet any expenditure on the landlord’s behalf. We cannot undertake to meet any outgoings beyond the funds we hold. If we do not hold funds to settle an invoice, we may provide your contact details to the supplier so that they can apply to you for payment, or we can request that the tenant pay for any repairs and send the invoice for payment by you.
3.31.Management Fee – Our Fee for providing the Management Service is 6% [ plus VAT @ 23%] of the annual rent reserved by the Tenancy Agreement based on a standard 1 year term.
3.32.ADDITIONAL SERVICES – In addition to our standard Lettings, Management & Corporate Relocation services Morrison Estates arrange and manage a range of services including cleaning and property maintenance, so that we can offer a complete turn key package to our clients.
